CENTRAL FLYWAY RETRIEVERS TERMS AND CONDITIONS
This Comprehensive Boarding and Training Services Agreement (hereinafter referred to as the "Agreement") is entered into by the undersigned Dog Owner/Client (hereinafter referred to as the "Client") and Central Flyway Retrievers (hereinafter referred to as "CFR") for the purpose of outlining the terms and conditions governing the residency, training, and care of the Client's dog (hereinafter referred to as the "Dog") while under the supervision and custodianship of CFR.
-----1. Financial Responsibilities and Payment Agreement
The Client expressly agrees to assume full and unequivocal responsibility for all financial obligations and expenditures associated with the Dog's entire residency period, including, but not limited to, boarding fees, training fees, competition and traveling fees, and any approved extraordinary expenses such as veterinary care.
1.1 Payment Schedule: Required payments for all services are strictly due and payable in full on the first calendar day of each month for the upcoming service period.
1.2 Alternative Arrangements: Any deviation from the standard monthly payment schedule must be explicitly documented and established through a separate, written financial arrangement mutually agreed upon and signed by both the Client and an authorized representative of CFR.
1.3 Accepted Payment Methods: Payments must be rendered exclusively via cash, certified check, Venmo or electronic bank transfer for the entire duration of the agreed-upon training or boarding period.
1.4 Late Fees and Default: CFR reserves the right to impose a late fee, the amount of which will be communicated separately, for any payment not received by the fifth day of the month. Consistent failure to meet financial obligations may result in the suspension of training services or, at the sole discretion of CFR, termination of this Agreement and required immediate retrieval of the Dog by the Client.
-----2. Health, Vaccination Certification, and Medication Consent
The Client hereby provides absolute affirmation and guarantee that the Dog is in good health and possesses current, valid protection against specified communicable diseases through the following required vaccinations:
2.1 Required Vaccinations:
-
Rabies: Current and administered by a licensed veterinarian.
-
Kennel Cough (Bordetella): Administered within the last six (6) months to one (1) year (as recommended by the administering veterinarian).
-
DHLPP: Protection against Canine Distemper, Infectious Canine Hepatitis, Leptospirosis, Canine Parainfluenza, and Parvovirus.
2.2 Indemnification Regarding Health: The Client agrees to fully absolve and hold Central Flyway Retrievers and its personnel harmless from any and all liability, costs, or claims for any illness, sickness, or disease contracted or incurred by the Dog resulting from a pre-existing condition, insufficient or outdated vaccination status, or exposure during the course of normal operation. The Client shall bear all costs associated with the treatment of such conditions.
2.3 Medication Authorization: The Client grants express, non-conditional authorization to Central Flyway Retrievers personnel to administer the Dog's regularly scheduled monthly heartworm preventative and external parasite (flea/tick) preventative medications, provided these medications are supplied by the Client in their original, clearly labeled packaging with specific dosing instructions.
-----3. Veterinary Care and Communication Authorization
The health and well-being of the Dog are paramount. The Client agrees to the following protocols for veterinary care:
3.1 Authorization for Emergency Care: Should the Dog necessitate urgent or non-elective veterinary attention while under the temporary custodianship of CFR staff, the Client hereby grants full and immediate authorization for CFR to seek appropriate emergency veterinary care. This authorization extends to, but is not limited to, the Client's primary veterinarian or the nearest available emergency veterinary facility.
3.2 Financial Responsibility for Veterinary Care: The Client acknowledges and agrees that they shall be solely responsible for all costs, charges, and expenses associated with any veterinary care, diagnosis, treatment, medication, surgery, or hospitalization required by the Dog. CFR will attempt to notify the Client prior to incurring significant expenses, but in an emergency situation, the Dog's welfare will take precedence over prior notification.
3.3 Communication Consent: To facilitate prompt and appropriate care, the Client expressly authorizes Central Flyway Retrievers personnel to engage in direct, unimpeded communication with the attending veterinarian(s) and to procure, share, and discuss all pertinent medical information, records, diagnoses, and proposed treatment plans concerning the Dog's condition with the veterinary staff.
-----4. Liability Waiver and Indemnification
The Client acknowledges and fully understands that participation in boarding, training, and outdoor activities carries inherent risks.
4.1 General Liability Waiver: The Client acknowledges the inherent potential for injury, illness, unforeseen accidents, and behavioral issues (including, but not limited to, altercations with other animals or self-inflicted injury) that may arise during the Dog's stay. The Client agrees to hold Central Flyway Retrievers, its owners, directors, employees, agents, and staff (collectively, the "Indemnified Parties") harmless and not legally liable in the event of such occurrences.
4.2 Full Indemnification: Furthermore, the Client explicitly agrees to indemnify, defend, and hold harmless the Indemnified Parties against any and all claims, demands, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:
-
The loss of the Dog—whether such loss occurs through disappearance, escape, theft, natural death, accidental death, or any other means whatsoever.
-
Any claim for damage or injury sustained by the Dog, or caused by the Dog to any third party (person, animal, or property).
4.3 Negligence Clause: This comprehensive liability waiver and indemnification shall remain in full force and effect regardless of whether the loss, disappearance, theft, damage, or injury is alleged, imputed, or definitively determined to have been caused, in whole or in part, by the ordinary negligence of Central Flyway Retrievers, its staff, or any other individual, or any other known or unknown cause(s). The Client waives any claim for damages greater than the cost of the services rendered
.-----5. Acknowledgment and Acceptance
By executing this Agreement, the Client hereby confirms that they have thoroughly read, fully comprehended, and unconditionally consented to all the terms and conditions, financial obligations, health requirements, and liability stipulations stipulated within this Comprehensive Boarding and Training Services Agreement.
